Velcro

They look similar but are classified differently.

Those are two kinds of Velcro. The difference between them is whether it’s a Made up article or not.
There is a definition of “Made up articles” in Note 7 to Section XI

① is not made up of articles defined in note 7 to Section XI but ➁ is.

①Tape, so-called Velcro binder 5806.10(DEBTI49848/21-1)
worked in two layers; with a fleece side made of loop fabric with pile and a hooked side made of velvet fabric with pile,
— made of man-made fibers

Mosaic made of cubes

Example classification case of Mosaic made of cubes used as a material for lining indoor walls.

The mosaic consists of glass cubes and stone cubes (numbered limestone).
When it comes to classification, we need to make clear how much area each material occupies.

In this case, the largest area is occupied by stone cubes (about 79%).
Therefore it is classified in 6802.10 as Tiles, cubes and similar articles applied GRI3b
Calculating the share of each material can be a hassle task.

Step stool

Classifying a Step stool is challenging.
①German customs(EU) classified it in 9403.70 as “Furniture”
➁U.S. customs(CBP) classified it in 3924.90 as “Household articles of plastics”

The reason why CBP classified it in 3924.90 is below.

The stools are designed to elevate a standing person in order to reach something or perform a task at a greater height.

The one-step step stool is more akin to a rung of a ladder in its utilitarian function.

Therefore, the one-step step stool is not properly classified in either Heading 9403
————————-
CBP’s interpretation is that stool is the kind of “Ladder” but German customs did not think so.

 

And here is also other pattern of classification by Japan customs.

Japan customs classified it in 3926.90 due to EN to 9403 exclusion.
(b) Ladders and steps, trestles, carpenters’ benches and the like not having the character of furniture; these are classified according to their constituent material (headings 44.21, 73.26, etc.).

 

This is a good example of the same kind of product having different HS codes depending on opinions from a different country Ladder or furniture.

Corkscrew

Here are two kinds of Corkscrew, they are very similar but classified in different subheadings.

① is 8205.51 ➁ is 8210.00.

They are used for removing a cork from a wine bottle by hand.
The only difference is whether it has a “gear mechanism”

① is regarded as “Hand tools”. On the other hand, ➁ is regarded as a “Hand-operated mechanical appliance”

It makes me shiver.

③Garden hose with spray gun 5909.00(DE5368-14-1)
I’m surprised to see that hose is more essential than a spray.
It seems it can be classified in 8424.89 but in this case, the garden hose imparts the essential character
especially with regard to the value compared to the spray gun.
